GTC – General Terms and Conditions of Riwax-Chemie AG
1. General
The general terms and conditions form an integral part of every contract concluded between Riwax-Chemie AG and one of its customers for the purchase of one of its products.
2. Use
The products supplied by Riwax-Chemie AG are intended exclusively for end consumption in Switzerland. Exceptions are only permitted with written authorization issued by Riwax-Chemie AG.
3. Prices
3.1. Deliveries will be invoiced at the agreed prices plus value-added tax.
3.2. As a general rule, prices are understood to be ex-works.
3.3. Freight costs, insurance, and permits shall be borne by the buyer.
4. Delivery
4.1. Riwax-Chemie AG determines the shipping route and method. If the buyer requests different shipping terms, they shall take delivery of the goods ex works.
4.2. Riwax-Chemie AG accepts no liability for coincidence, force majeure, and slight negligence.
4.3. In the event of delivery difficulties, Riwax-Chemie AG has the right to make partial deliveries.
4.4. The place of performance is Bern.
5. Returnable packaging
Empty containers must be returned immediately carriage paid to Zollikofen or via a truck belonging to Riwax-Chemie AG.
6. Payment
6.1. Unless otherwise agreed in writing, invoices are payable within 30 days of receipt of the invoice.
6.2. In the event of late payment, Riwax-Chemie AG reserves the right to withdraw from the contract and take back the delivered goods.
6.3 In case of late payment, the reminder fee is CHF 20 for the first reminder and CHF 20 for each subsequent reminder.
7. Defective goods
7.1. Notices of defects regarding obvious defects will only be considered if they are raised within 8 days of receipt of the goods at the destination.
7.2. Defective goods may only be returned with the authorization of Riwax-Chemie AG.
7.3. Riwax-Chemie AG reserves the right to make replacement deliveries.
7.4. If Riwax-Chemie AG waives a replacement delivery, the buyer only has the right to rescission. A price reduction is not possible.
8. Privacy Policy
8.1 The personal data collected by Riwax-Chemie AG within the framework of customer relationships (information that directly or indirectly identifies a natural person) will be stored and may be used both for contract processing and for other purposes (e.g., marketing or statistics).
8.2 The data may also be exchanged with and used by affiliated companies of the RIWAX Group.
8.3 The customer consents to this potential use of their personal data. They can notify us at any time at 031 910 45 45 that they no longer wish for their data to be used.

9. Place of jurisdiction and applicable law
The place of jurisdiction for all disputes is Bern. Swiss law applies.
